Terms of service
These Terms and Conditions govern the sale and supply of products through The Recycling Factory website. By accessing or using this website, or by placing an order with us, you agree to be bound by these Terms and Conditions.
In these Terms and Conditions, “The Recycling Factory”, “we”, “us” or “our” means The Recycling Factory, and “Customer”, “you” or “your” means the person or organisation purchasing, or seeking to purchase, products from us.
These Terms and Conditions apply to all orders and purchases made through our website unless otherwise agreed by us in writing.
1. General
1.1 All quotations, orders and sales are subject to these Terms and Conditions.
1.2 These Terms and Conditions constitute the agreement between you and The Recycling Factory in relation to the purchase of products from us and supersede any other terms or conditions proposed by you, unless expressly agreed by us in writing.
1.3 By placing an order through our website, you confirm that you have read, understood and accepted these Terms and Conditions.
1.4 Nothing in these Terms and Conditions affects or limits any statutory rights you may have as a consumer under applicable UK law.
2. Product Range and Descriptions
2.1 Our product range may include, but is not limited to:
-
new and compatible inkjet cartridges;
-
remanufactured inkjet cartridges;
-
new printers;
-
renewed printers;
-
refurbished laptops;
-
printer and computer accessories;
-
consumables; and
-
other technology, printing and office-related products offered from time to time.
2.2 We make reasonable efforts to ensure that product descriptions, images, specifications and other information displayed on our website are accurate and up to date. However, images are for illustrative purposes only and products may vary slightly in appearance, packaging or specification.
2.3 For refurbished, renewed or remanufactured products, descriptions will identify the condition and/or grade of the product where applicable. These products may show reasonable signs of previous use or reconditioning.
2.4 We reserve the right to amend, withdraw or update products, specifications, descriptions and availability without prior notice.
3. Quotations
3.1 Unless otherwise stated, quotations issued by us remain valid for 30 days from the date of quotation.
3.2 A quotation does not constitute a binding contract until your order has been accepted by us.
3.3 We reserve the right to withdraw or amend a quotation where circumstances outside our reasonable control affect product availability, pricing or specification.
4. Prices and VAT
4.1 All prices displayed on our website are stated in pounds sterling (£) and, where applicable, include or exclude VAT as clearly indicated.
4.2 Where VAT or any other applicable tax or statutory charge is payable, this will be charged at the prevailing rate at the time of supply.
4.3 Prices are subject to change without notice. Any change in price will not affect an order that has already been accepted by us, except where an obvious pricing error has occurred.
4.4 While we take reasonable care to ensure that prices displayed on our website are accurate, errors may occasionally occur. If a product is listed at an obviously incorrect price due to a typographical, technical or pricing error, we reserve the right to cancel the affected order and refund any payment already made.
5. Orders and Acceptance
5.1 When you place an order through our website, you are making an offer to purchase the products selected by you.
5.2 An automated order acknowledgement confirms that we have received your order but does not necessarily constitute acceptance of the order.
5.3 A contract for the supply of products is formed when we confirm acceptance of your order or dispatch the products to you, whichever occurs first.
5.4 We reserve the right to decline or cancel an order where:
-
the product is unavailable;
-
there has been an obvious pricing or product description error;
-
we are unable to obtain payment;
-
there are reasonable grounds to suspect fraudulent or unauthorised activity; or
-
circumstances beyond our reasonable control prevent fulfilment of the order.
5.5 If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled products.
6. Payment
6.1 Payment must be made using the payment methods made available through our website unless alternative payment terms have been agreed with us in writing.
6.2 Payment will not be regarded as received until cleared funds have been received by us.
6.3 Where we have agreed credit or open-account terms with a Customer, invoices are due for payment on the last day of the month following the month in which the invoice is issued, unless otherwise agreed in writing.
6.4 We reserve the right to suspend or withhold further deliveries where payment is overdue or where the Customer is otherwise in breach of agreed payment terms.
6.5 Where payment is overdue, we reserve the right to charge interest in accordance with applicable UK legislation, from the date payment became due until payment is made in full.
7. Delivery
7.1 We will make reasonable efforts to deliver products within the estimated delivery times stated on our website or provided at the time of order.
7.2 Delivery dates and times are estimates only unless we have expressly agreed otherwise in writing.
7.3 We will not be liable for delays caused by circumstances beyond our reasonable control, including but not limited to:
-
strikes or industrial disputes;
-
shortages of materials, labour or transport;
-
severe weather;
-
fire;
-
flood;
-
natural disasters;
-
war or civil unrest;
-
interruptions to utilities or telecommunications; or
-
failures or delays caused by third-party carriers or suppliers.
7.4 If delivery is delayed, we will take reasonable steps to keep you informed where practicable.
7.5 Risk in the products will pass to you in accordance with applicable law and, where applicable, upon delivery to you or to a carrier nominated by you.
8. Inspection and Damaged or Incorrect Products
8.1 You should inspect products as soon as reasonably practicable after delivery.
8.2 If products arrive visibly damaged, are incorrect, incomplete or appear to have a fault, you should contact us promptly with details of the issue and, where appropriate, photographs of the packaging and product.
8.3 Where a product is confirmed to be defective, damaged or not as described, we will provide an appropriate remedy in accordance with your statutory rights and these Terms and Conditions.
8.4 Nothing in this section limits any rights you may have under applicable consumer protection legislation.
9. Product Warranty
9.1 Unless otherwise stated on the relevant product page or documentation, products may be supplied with a manufacturer's, supplier's or The Recycling Factory warranty.
9.2 Warranty periods for refurbished and renewed products are specific to the relevant product category and will be stated on the applicable product listing, documentation or order confirmation.
9.3 Remanufactured inkjet cartridges may be subject to the applicable cartridge warranty stated on the product listing or accompanying documentation.
9.4 Our warranty covers hardware faults and defects arising during the applicable warranty period.
9.5 The warranty does not cover technical, software, configuration, compatibility, connectivity, operating-system or user-related issues where the product itself is not suffering from a hardware fault.
9.6 Unless otherwise expressly stated, warranty coverage does not include faults or damage caused by:
-
misuse, abuse or accidental damage;
-
liquid or physical damage;
-
unauthorised modification or repair;
-
incorrect installation or operation;
-
use contrary to the manufacturer's instructions;
-
unsuitable accessories, consumables or third-party components;
-
viruses, malware or other software-related issues;
-
normal wear and tear; or
-
any other circumstances outside the intended use of the product.
9.7 Where a product develops a suspected hardware fault during its applicable warranty period, you should contact us before attempting any repair or modification. We may require the product to be returned for inspection and testing.
9.8 Where a warranty claim is accepted, we may, at our discretion and subject to your statutory rights, repair the product, replace it with an equivalent product, or provide another appropriate remedy.
9.9 A warranty claim does not automatically confirm that a product is defective. Products returned under warranty may be inspected and tested to establish the nature and cause of the reported fault.
10. Remanufactured Inkjet Cartridges
10.1 Remanufactured inkjet cartridges are previously used cartridges that have been professionally processed, cleaned, inspected, refilled and/or had components replaced as appropriate before being offered for resale.
10.2 Because remanufactured cartridges are reconditioned products, their appearance, packaging and component configuration may differ from new original-equipment products.
10.3 Remanufactured cartridges are supplied for use in compatible printer models as specified in the relevant product description.
10.4 References to printer manufacturers or original equipment manufacturers (OEMs) are made solely to identify compatibility and do not imply that our products are manufactured, endorsed or approved by those manufacturers unless expressly stated.
11. Renewed Printers and Refurbished Laptops
11.1 Renewed printers and refurbished laptops are products that have previously been used and have undergone an assessment, testing, cleaning, refurbishment or renewal process before being offered for sale.
11.2 The condition, cosmetic grade, specification and included accessories of renewed printers and refurbished laptops will be stated on the relevant product listing wherever applicable.
11.3 Refurbished and renewed products may display reasonable signs of previous use. Cosmetic imperfections that are consistent with the stated condition or grade will not necessarily constitute a hardware fault.
11.4 Warranty periods for renewed printers and refurbished laptops are determined by their respective product categories and will be stated on the relevant product listing or documentation.
11.5 Warranty coverage applies to hardware faults only and does not ordinarily cover technical support, software configuration, operating-system issues, user setup, compatibility issues or other matters where the hardware itself is functioning correctly.
12. Manufacturer and End-User Warranties
12.1 Where a product is supplied with a manufacturer's or brand-specific warranty, the terms of that warranty may apply in addition to these Terms and Conditions.
12.2 Where applicable, details of any manufacturer or brand-specific warranty will be made available with the relevant product or on request.
12.3 For Jet Tec branded products, the applicable Jet Tec end-user warranty will apply where specified with the product.
12.4 Jet Tec products are warranted against defects arising from faulty materials or workmanship, subject to the terms and exclusions of the applicable warranty.
12.5 Where a Customer alleges that a Jet Tec product has caused damage to a printer, The Recycling Factory may require the relevant printer and product to be returned for inspection and testing.
12.6 Where inspection establishes that damage was directly caused by a Jet Tec product under normal intended use, the applicable remedy will be determined in accordance with the relevant Jet Tec warranty and applicable law.
12.7 A warranty claim may be rejected where the product has been deliberately or negligently damaged, dismantled, modified, tampered with, misused or otherwise used outside its intended application.
13. Technical Support
13.1 Unless expressly stated otherwise, the purchase of a product does not include unlimited technical support, installation, configuration or troubleshooting services.
13.2 Warranty coverage relates to qualifying hardware faults and does not constitute a general technical-support service.
13.3 Where a reported issue appears to be software-related, configuration-related, compatibility-related or otherwise unrelated to a hardware fault, we may advise you of the appropriate troubleshooting steps or recommend that you seek assistance from the relevant software or equipment manufacturer.
14. Specifications and Product Information
14.1 We make reasonable efforts to ensure that specifications, product descriptions, photographs, brochures and other published information are accurate.
14.2 However, specifications, photographs, colours, packaging and other product information may vary slightly from the information displayed online.
14.3 We reserve the right to update specifications, prices, product descriptions and availability without prior notice.
14.4 Where a refurbished, renewed or remanufactured product is supplied, the specification stated on the product listing at the time of purchase will apply, subject to reasonable variations that do not materially alter the product.
15. Intellectual Property and Trademarks
15.1 All intellectual property rights in the content of this website, including text, graphics, logos, photographs, designs and other materials, belong to The Recycling Factory or its respective licensors unless otherwise stated.
15.2 Nothing in these Terms and Conditions grants you any right to reproduce, copy, modify, distribute or commercially exploit our website content without our prior written permission.
15.3 Any trademarks, brand names or logos belonging to original equipment manufacturers (OEMs) referred to on our website or in our literature are the property of their respective owners.
15.4 OEM trademarks and product references are used solely to identify products, compatibility or intended use and do not imply any affiliation, sponsorship, endorsement or approval by the relevant manufacturer unless expressly stated.
16. Website Use
16.1 You agree to use this website lawfully and not to misuse, disrupt, damage or attempt to gain unauthorised access to any part of the website or its systems.
16.2 We do not guarantee that the website will always be available, uninterrupted or free from errors, although we will take reasonable steps to maintain its availability and security.
16.3 We reserve the right to suspend, withdraw or modify any part of the website without notice where reasonably necessary.
17. Limitation of Liability
17.1 Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation would be unlawful.
17.2 Subject to clause 17.1, we will not be liable for losses that are not reasonably foreseeable or for losses arising from circumstances outside our reasonable control.
17.3 Nothing in these Terms and Conditions affects any statutory rights or remedies that cannot legally be excluded or restricted.
18. Consumer Rights
18.1 If you are purchasing products as a consumer, you have statutory rights under applicable UK consumer protection legislation.
18.2 These rights may include rights relating to the quality, conformity, description and fitness for purpose of products, as well as rights concerning cancellation and refunds where applicable to online purchases.
18.3 Nothing in these Terms and Conditions is intended to remove or reduce any statutory consumer rights that apply to your purchase.
19. Competitions and Promotions
19.1 Additional terms and conditions may apply to competitions, promotions, discount codes, prize draws or other promotional activities.
19.2 Where additional terms apply, they will be made available at the time the relevant promotion or competition is published.
20. Assignment
20.1 You may not transfer or assign your rights or obligations under a contract with us without our prior written consent, except where permitted by law.
20.2 We may transfer or assign our rights and obligations where reasonably required as part of the operation or restructuring of our business, provided that your legal rights are not adversely affected.
21. Severability
21.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that provision shall be deemed to be removed or modified to the minimum extent necessary.
21.2 The remaining provisions will continue to apply in full.
22. Changes to These Terms and Conditions
22.1 We reserve the right to update or amend these Terms and Conditions from time to time.
22.2 The latest version will be published on The Recycling Factory website and will take effect from the date stated at the beginning of the updated Terms and Conditions.
22.3 Changes will not retrospectively affect contracts that have already been accepted, except where required by law.
23. Governing Law and Jurisdiction
23.1 These Terms and Conditions and any contract between you and The Recycling Factory shall be governed by and construed in accordance with the laws of England and Wales.
23.2 Subject to any mandatory consumer rights, the courts of England and Wales shall have jurisdiction in relation, a product, an order or a warranty to any dispute arising from or in connection with these Terms and Conditions or any contract between you and The Recycling Factory.
24. Contact
